MLABS Terms of Service & Privacy Policy

1. Introduction & Legal Scope

This document constitutes a legally binding agreement between you (either an individual or a single entity) and Nguyễn Đức Mạnh / Manh Nguyen (MLABS) (“I,” “my,” or “MLABS”). It governs your use of MLABS software applications, add-ins, extensions, plugins, and tools—including but not limited to solutions developed for Autodesk Revit, AutoCAD, other CAD/BIM host platforms, and desktop computer software applications in general (both free and paid versions, collectively referred to as “Software” or “Extensions”)—as well as the website (https://mlabsolution.com/) (“Website”).

This policy complies with applicable global data protection regulations, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

2. Information Collected & Telemetry

I collect only the minimum amount of technical and account information strictly necessary to operate the Software, validate licensing, provide customer support, and ensure stability.

A. Personal & Account Information:

  • Contact Details: Your name, email address, and company name provided during license purchase, activation, registration, or technical support requests.
  • User Identifiers: Your Windows username and/or Autodesk username, retrieved automatically by the Software solely for license validation, troubleshooting, and abuse prevention.
  • Financial & Payment Details: All payment transactions are handled directly and securely through authorized third-party merchant platforms: Lemon Squeezy (Merchant of Record for purchases on mlabsolution.com) or the official Autodesk marketplace (currently known as Autodesk Design and Make Marketplace, formerly Autodesk App Store, or any successor platform operated by Autodesk, Inc.). MLABS does not collect, receive, or store your credit card numbers or banking information.

B. Licensing & Activation Data:

  • License Keys & Entitlements: Your active License Key (issued via Lemon Squeezy) or Autodesk Entitlement status (verified via the Autodesk Entitlement API or its successor services).
  • Machine Identifier (Machine ID): A hashed hardware/machine ID used strictly to enforce seat/device limits and facilitate authorized device migration by the licensee.

C. Technical & Diagnostic Telemetry:

  • Host Application & Environment Info: The specific version of Autodesk Revit, AutoCAD, or other host applications being used, along with basic operating system information.
  • MLABS Command Usage: The specific names of tools and commands executed strictly within MLABS Software (e.g., clicking an MLABS ribbon button).
  • Performance Metrics: Command execution duration and timestamps to detect performance bottlenecks, software incompatibilities, or bugs.
  • Website Technical Data: Standard server logs, IP address, and browser data collected when visiting mlabsolution.com.

🛡️ Strict Design & Project Data Privacy Guarantee:
The Software operates and processes your files strictly locally on your computer. MLABS never tracks, records, inspects, stores, or transmits any general host application commands (in Revit, AutoCAD, or any other host system), user project files, CAD drawings (DWG, DXF), BIM models (RVT, IFC), 2D/3D geometry, proprietary family parameters, design content, or activities of third-party plugins.

3. Purpose of Processing & Lawful Basis (GDPR)

I process personal and technical data on the following lawful bases:

  • Contractual Necessity: To deliver free and purchased Software, validate active licenses across devices, maintain compatibility, and fulfill customer support or refund requests (including our 14-day Lemon Squeezy guarantee).
  • Legitimate Interests: To optimize tool stability, troubleshoot crashes, debug issues across host application releases, and protect our intellectual property against piracy, unauthorized license sharing, or cracking.
  • Legal Obligation & Consent: To comply with applicable statutory accounting and tax standards, and when you voluntarily opt in to receive updates or newsletters.

4. Third-Party Sharing & Tracking Technologies

MLABS does not sell, rent, or trade your personal or telemetry data. Data is shared solely with trusted operational partners under strict confidentiality:

  • Authorized Merchant & Distribution Platforms: Lemon Squeezy (for website billing and license delivery) and Autodesk, Inc. (via Autodesk Design and Make Marketplace / Autodesk App Store, or successor platforms, for authentication and entitlement checks).
  • Infrastructure & Security Providers: Secure hosting environments utilized to conduct automated license verification and collect anonymous error telemetry.

The Website does not utilize invasive tracking cookies or cross-site advertising trackers. MLABS desktop applications do not deploy cookies or tracking scripts.

5. Disclaimer of Warranty & Limitation of Liability

A. “AS IS” Provision:
THE SOFTWARE AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. MLABS DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM DESIGN INCOMPATIBILITIES ACROSS HOST PLATFORMS.

B. Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NGƯYỄN ĐỨC MẠNH OR MLABS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, CORRUPTION OF CAD DRAWINGS OR BIM MODELS, LOSS OF PROFITS, BUSINESS INTERRUPTION, PROCUREMENT OF SUBSTITUTE GOODS, OR DELAYS IN CONSTRUCTION/ENGINEERING PROJECTS) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

C. User Responsibility for Backups & Verification:
Users acknowledge that automated software tools in architectural, engineering, and drafting workflows are aids, not substitutes for professional oversight. Users are solely responsible for verifying the accuracy of drawing and modeling results and maintaining regular, independent backups of all files and databases prior to executing automated operations.

6. Governing Law & Dispute Resolution

A. Governing Law:
This Agreement, Privacy Policy, and any claims, controversies, or disputes arising out of or related to the Software, Website, or transactions shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to its conflict of law principles.

B. Exclusive Jurisdiction:
Any legal suit, action, or proceeding arising out of or related to this Agreement or the Software shall be instituted exclusively in the competent courts of Vietnam. You hereby irrevocably submit to the exclusive personal jurisdiction and venue of such courts and waive any objection based on forum non conveniens.

7. Consumer Rights (GDPR & CCPA)

Regardless of user location, we uphold international standards of privacy:

  • European Economic Area & UK (GDPR): You possess rights of access, rectification, erasure (“right to be forgotten”), data processing restriction, and data portability.
  • California Residents (CCPA): You have the right to request disclosure of personal information collected, request deletion of your information, and opt out of data sales (MLABS does not sell personal data). You will not be subject to discriminatory treatment for exercising these rights.
